ABSTRACT Federal Express Ground has created a business model that has made it highly competitive in the package delivery industry; FedEx hires its drivers as independent contractors. This business model is not unique. In many industries workers are customarily hired as independent contractors to avoid the liability and expense associated with an employer/employee relationship. While potentially profitable, this business model also exposes the hiring party to lawsuits by workers claiming that they are employees rather than independent contractors. Currently Federal Express Ground is facing a wave of such lawsuits. This paper considers the employment status of FedEx drivers by examining the tests used to classify workers as either employees or independent contractors and by comparing FedEx drivers to drivers in the courier service industry who have been found to be employees rather than contractors.
